Collectively, all of the above people or businesses entering this Agreement will be referred to as the “Parties.”

We want the adoptive parent(s) and/or family to be completely happy with the new kitten and his or her transition to the new home. Transitioning is easy for some kittens but more difficult for others, and kittens handle stress in various ways. In the following contract we want to address all common issues, please call us if you have any questions.

Purpose of the Agreement

The client is buying a Maine Coon kitten from the seller and will abide by the rules detailed in this agreement.  

Terms

Deposit A non-refundable deposit of $1,500.00 is required for purchase of the kitten. Should the purchaser, after having paid the deposit, decide against purchasing the kitten, he or she forfeits the deposit. The deposit can be used for the purchase of a different kitten. We do not reserve a kitten without a deposit.

Health Insurance

Insurance is mandatory at the time of pick-up. We offer a special 30-day insurance plan through Trupanion at no upfront cost to you. This is a zero-obligation offer (except for residents of New York) and does not require a credit card to activate, but it ensures IMMEDIATE COVERAGE for your new kitten.

We require you activate Trupanion insurance one day prior pick up or the day of, to ensure your kitten’s coverage during the crucial transition from our home to yours. We will not release your kitten until proof of active insurance is provided.

You can activate the Trupanion health plan on pick-up day. To make the process smoother, we recommend completing the activation a day before. The only way to bypass this requirement is: If you prefer to use a different insurance company. Please provide proof of active insurance with another company at the time of pick-up. If you do not present this proof, you will be required to activate Trupanion with our promo code.

FYI, WE DO NOT MAKE ANY MONEY OR COMMISSION OF ANY KIND, GIFTS, OR ANY FORM OF REMUNERATION FROM TRUPANION.

Health Guarantee

The seller will provide purchaser with Early Care Plus plan from Banfield. Covers 12 months of treatment for your kitten.

Spay/Neuter Agreement

This cat is being sold with no breeding rights and on a spay/neuter agreement.

We use binding contracts to ensure cat sterilization at a healthy age. We’ll follow up with you to provide advice and reminders, ensuring your kitten’s sterilization. 

How it Works
 

1. You sign the contract, agreeing to take your pet to a Banfield veterinarian to have the pet surgically altered for spay or neuter by 6 months of age, and provide proof to us via email.
    
2. Bellspurr will send you reminders of your pet’s sterilization deadline. You schedule an appointment with your local Banfield veterinarian for a feline sterilization surgery.
    
3. When the time comes, you take your kitten to the vet, have them fill out the proof confirmation form, and send it to lucyappel@bellspurr.com along with the procedure’s invoice and any other supporting documents from your vet. Please send all proof documentation directly to my email.
    
4. If the cat is not spayed/neutered by five lbs. or six months of age and/or proof of sterilization is not provided, Bellspurr will enforce breach of contract for the maximum civil sanction, and dollar dollar amount, up to $10,000.00 per disparagement penalty for liquidated damages enforced legally by all States of USA.

Treatment of Cat

Under NO circumstances shall this kitten be de-clawed. Declawing is amputation and is often the cause of litter box problems (“inappropriate elimination”). This can lead to abuse or abandonment of the cat/kitten, a risk that the seller is not willing take. The purchaser agrees under no circumstances, allow the cat to be declawed.

Under NO circumstances shall this kitten/cat be permitted to live outdoors.

Under NO circumstances shall this kitten/cat be tattooed, pierced, or undergo any unnecessary “fashionable” body modification.

The new cat should be confined to a private room with toys, food, the kitten’s litter box, and plenty of human contact until accustomed to his/her new surroundings. Seller will provide a list of the foods and supplements the cat will need. Please be careful that his or her diet is not changed drastically. 

Breed Considerations

Maine Coons have big ears, we recommend for you to check them regularly. If you feel a crust, take them to the vet. It is not an emergency but needs to be treated as soon as possible with antibiotics.

Relinquishment of Ownership of Cat or Permanent Transfer of Cat by Purchaser

The purchaser agrees that under NO circumstances will the kitten/cat EVER be sold or given to a pet shop, animal shelter, research laboratory, or similar facility. Should the purchaser, for any reason, including death, not be able to keep the above kitten, the seller will be given the first option of rescuing the cat at no cost.  

Breach of Contract

In the event the purchaser is found to have violated any of the terms and conditions of this contract, the cat is to be surrendered unconditionally to the seller. Seller may reclaim physical and legal ownership of cat with or without due process of law for any breach of contract with no refund of purchase price.

State Law

This Agreement shall be interpreted under, and governed by, the laws of the state of Texas,  Integration There are no other conditions or guarantees, verbal or implied. No verbal deviations or additions are valid. No other warranties or guarantees are provided other than those specifically outlined in this Contract. Acknowledgement of Deposit Paid and Acceptance of Contract Purchaser and seller signatures that appear immediately below indicate that the seller has received the deposit and the purchaser has agreed to the terms of this contract. This portion serves as the Purchaser’s receipt for the deposit. This document is a legally binding contract. In signing this document the Purchaser acknowledges that he or she has read, fully understands, and agrees to ALL of the terms and conditions stated above.
